Personal Injury from Tobacco

Because cigarettes are a consumable product, most successful lawsuits involve products liability and warranty issues.  This area of law states that products which have risks that are unforeseen by consumers, or the manufacturers failure to warn about potential hazards, make the manufacturer liable for injuries. Secondhand smoking can be included in the lawsuits too but is best dealt individually. The link between secondhand smoke (also called environmental tobacco smoke) and disease is well known, and the connection to cardiovascular-related disability and death is also clear. About 22,700 to 69,600 premature deaths from heart and blood vessel disease are caused by other people’s smoke each year.

Smoking is clearly a liability. People smoke because of its calming effects in the body. Others have considered their smoking as a habit consuming from one stick to up to two packs per day. It has been a part of their daily system that it creates a void when taken out. And an abrupt removal can lead to nicotine withdrawal syndrome depending on the severity and length of time smoking. Symptoms include an intense craving for nicotine, tension, irritability, headaches, difficulty concentrating, drowsiness and trouble sleeping and increased appetite and weight gain. It is important to create a system of support from friends, social groups and most all family members to increase the chances of withdrawing from smoking. It is difficult to let go of something that has been an integral part of your system. But with the facts presented, one must reconsider the harmful risk over the benefits. In the end, it is your life we are talking about. And it is not too late to quit smoking. From the 20 minutes you inhaled your last cigarette, blood pressure and pulse returns to normal and the benefits continues when you quit giving you a chance to live a longer and fulfilling life.
